Artificial Intelligence and Data Act (AIDA) is a proposed law using a modified risk-based approach. Federal: Directive on Automated Decision-Making • Only applies in the public federal sector • Involves assessment, transparency and quality assurance requirements Bill C-27 Introduction of the Consumer Privacy Protection Act (the “CPPA”): • The same Bill that proposes the introduction of the Artificial Intelligence and Data Act • It would repeal parts of the Personal Information Protection and Electronic Documents Act and replace them with a new legislative regime governing the collection, use, and disclosure of personal information for commercial activity in Canada • Under s. 62(2)(c), organizations must make available “a general account of the organization’s use of any automated decision system to make predictions, recommendations or decisions about individuals that could have a significant impact on them” • Under s. 63(3), if an organization has used an automated decision system to make a prediction, recommendation or decision about an individual that could have a significant impact on them, the organization must, on request by the individual, provide them with an explanation of the prediction, recommendation or decision. The explanation must indicate the type of personal information that was used to make the prediction, recommendation or decision, the source of the information and the reasons or principal factors that led to the prediction, recommendation or decision. Quebec: Bill 64 – The Act to Modernize Legislative Provisions respecting the Protection of Personal Information • Amends the Act Respecting the Protection of Personal Information in the Private Sector • Has received Royal Assent and comes into force September 22, 2023 • Adopts the right to object to the use of personal information being used to render a decision based exclusively on automated processes, and certain rights to information regarding such processes Ontario: Ontario’s Trustworthy Artificial Intelligence Framework • The public consultation period ran from May 7 to June 4, 2021 • Focus is on the use of AI by the Government of Ontario • Suggests that Ontario will use AI in a way that is transparent, secure and equitable • Although there is no explicit commitment to regulating AI in the private sector, this suggests that the Government of Ontario recognizes AI as an emerging issue
